PREFACE

In the present age, industrialization and globalization are gradually becoming a trend
in all over the world, this thing have been created many potential chances for
developing nations including Vietnam. in the relationship between nations nowadays,
economic becomes the most important factors to be discussed. Foreign trade is the
way that Vietnam must be focus on since joined the WTO. In addition, with the
“Trans-Pacific Strategic Economic Partnership Agreement (TPP)” was successfully

negotiated in October 2015 between 12 countries including Vietnam that make import
and export activities become more vigorous than ever. So promote and priorities for
the export and import to create a competitive advantage is essential. Therefore,
forwarding services in Vietnam develop increasingly powerful. It has led to companies
frequently identify human resources.
Vietnam Maritime University is a university that resonates in the training human
resources in the maritime sector as Maritime economic, navigation ... So I had the
opportunity to study and acquainted about export and import factor. During times I
study in Vietnam Maritime University, I had a chance to internship at DH Logistics –
Haiphong branch, one office of DH Logistics Co.,Ltd in the northern of Vietnam. DH
Logistics limited company is a company which specialized in road transportation,
forwarding process, import and export from Vietnam to other country surrounding
area. Now, I would like to present my dissertation about recommendations to improve
container forwarding services at DH Logistics – Haiphong branch.
I also want to give my thanks to the general director and all the staff of DH Logistics
who allowed me to practice at the company.

INTRODUCTION
The important of the topic
Nowadays, economic integration increased rapidly bring opportunities to enhance
exports and imports more than ever. With the development of foreign trade, logistics
services also expanding in both quality and quantity terms and it plays an important
role in the transport of goods. In Vietnam, foreign trade play an important role in the
development of the economy and it makes the relationships between Vietnam and
other nations become closer. Understand the important of forwarding services, I
would like to choose the topic: “recommendation to improve freight forwarding
process in DH Logistics - Haiphong branch” to write in this dissertation.

Research Object

This research is not only about learning in DH Logistics Co.,LTD – Haiphong
branch but also clarifying the cargo forwarding activities, the current status of
LCL/FCL cargoes activities at DH Logistics Co.,LTD – Haiphong branch. Then
point out the strength, weakness, opportunities and threat of the company in their
activities, and in the last part is the recommendations for DH Logistics.
Research Scope-subject
Research Subject: recommendation to improve freight forwarding services in DH
logistics Co.,LTD - Haiphong branch.
Research Scope: The reality and current status of freight forwarding services in
DH logistics Co.,LTD - Haiphong branch.
Research Method
Analysis: Collecting data in many ways. In this research, I use two ways to collect
data and evaluate the activities of the company are interviewing company’s staffs
and comparisons numbers from annual reports. From that, making evaluations and
recommendations about company activities.

Comparisons numbers in a period of 3 years (from 2012 to 2014).

CHAPTER 1: LITERATURE REVIEW
1. Freight forwarding services

In the present age, the globalization help cargo from a countries can go around the
world. However, to transport cargo to another nation take many step. Therefore,
forwarders was found to organize the process of transportation and finish all the
documents related.
According to FIATA (French: Fédération Internationale des Associations de
Transitaires et Assimilés), "forwarding service is defined as any kind of services
related to transportation, consolidation, warehousing , loading, packing or
distribution of goods as well as consulting services related to the above services,
including customs issues, finance, insurance, billing, collecting documents related.”
In Vietnam, Forwarding services was appear first time in the Commercial Law in
1997. In the article 163 of Vietnam Commercial Law 1997, forwarding services is
defines as a commercial activity. Which the forwarders receive cargoes, organize
the types of transportations, warehousing, finish all the documents and related
services, packaging, loading and unloading… from the consignors to the
consignees.
2. Freight forwarders

Freight forwarders or forwarders, forwarding agent is the person who conduct the
forwarding services. According to FIATA, "forwarder is the person who endeavored
to goods transported under trust contract and act for the benefit of the settler. The
forwarder also responsible for all the services related to forwarder contracts as
storage, warehousing, customs procedures, cargo check”.
The forwarder can be ship owner (as ship owners on behalf of shippers perform
forwarding services), the shipper (when shippers undertakes work themselves its
freight forwarding), the company handling or warehouse, freight forwarder or any
other professional person have business registered freight forwarding services.
3. Forwarder responsibilities and rights.


In article 167 of Vietnam Commercial law, forwarder have the right to:

Forwarders have the rights to get wages and other reasonable income.
Fully implement their obligations under the contract.
In the course of executing the contract, because of the legitimate interests of
customers, forwarder can perform in a difference way from the directed by
the client, they have to notify to customers as soon as possible.

Besides, there are some responsibilities that forwarders have to follow in article 167
of Vietnam commercial law:

After contracting, if forwarders cannot follows the require of customers, they

have to notify to customer immediately.
Forwarder must perform their obligations in a reasonable time if the contract
do not have the agreed on the time and obligations with customers.
o If forwarder is an agent, they have to response to the mistake such as:
Incorrect delivery instructions.
Shortcomings in purchase cargo insurance although there have been
guidance.
Shortcomings in customs procedures.
Transporting cargo to the wrong place.
Do not follow the necessary procedures of re-export or no refund.
Delivery but not collect money from the consignee.
Responsible for the damage caused to 3rd party in their activities, but not
responsible for the damage that caused by the 3rd party.
o If forwarder is a carrier:
Responsible for providing the services that customers demand.
Responsible for the damage that caused by 3 rd party (the people that
forwarder hire to perform the contract with customer).
4. Forwarder liability.
The Liability of forwarder as forwarding agent:

Depending on the function of the forwarder, they have to responsible for:

Delivery improper instructions
Delivery to wrong receiver
Delivery without collecting from the consignee.
Failure in purchase insurance for the goods despite instructions.
Failure in make customs procedures
Transporting goods to the wrong place regulations Delivery without
collecting from the consignee


Liability to customs
Most of the nations that the person perform customs declaration must be responsible
to the customs authorities about compliance with customs regulations on the right to
declare the quantities and values commodity name to avoid losses to the
government. If violated these rules, the forwarder will be fined but the fine was not
reclaim from the customer.
Liability to third parties
Forwarders have to responsible to third party about:
+ Loss of material assets of third parties and the consequences of such loss.

+ The third party injury or illness and the consequences of that.

Liability of forwarder in entrustment contracts:

The forwarders often act as entrustment contracts when collecting the LCL cargoes.
Therefore, the forwarders must response for the loss of people's assets and the third
party that the forwarder caused
5. Legal basis framework

The allocation of import and export goods should be based on a legal basis from

both international and Vietnam legal.

National law:

Maritime Code of Vietnam's first State Council promulgated in 1990 replacing the
previous bylaws (government declared 1977 to 1982 the territorial waters of width,
Decree 30 / CP dated 29/01/1980 on the regulation on foreign vessels operating in
the waters of Vietnam), marking a new step in the process of codification of
maritime law.
In 2005, Congress enacted the Maritime Law No.40 / 2005 / QH11 substitution of
maritime law in 1990, finishing more than the legal relations arising from maritime
activities, including the provisions on ships, crew, port, maritime channels, maritime
transport, safety and maritime security, civil liability of ship-owners, general
average, resolve maritime disputes, prevent environmental pollution and other
activities related to the use of sea vessels for purposes of economic, cultural, social,
sports, public service and scientific research. Code is built on the basis of studies
prescribed by the law and international conventions related to marine as 24 of the
Convention of the International Maritime Organization, 05 of the UN Convention the rules of CMI and 03 of the UN Convention - UNCITRAL rules, 03 of the UN
Convention - the rules of UNCTAD, 18 of the Convention of the International
Maritime Commission (Brussels) (basically making Code provisions similar to the
Hague-Visby Rules and Hamburg Rules 1978 1968 is the international conventions
relating to Bills of Lading) .in 2006, the VN Officially recognized companies that
contained Favorable Convention for ships to enter ports conditions END_SPAN
(FAL- 65). Decree 140/2007 am also adjusted Logistics Activities and Decree
87/2009 / ND-CP about the Multimodal transport ... are important, legal basis and
freight logistics that Impacts on forwarding services in VN.
Some forwarding principles in Vietnam.
- The allocation of import and export goods at the port due to port conducted on the
basis of contracts between shippers and shippers who are entrusted with the port.

- For those goods not through the port (no storage at the port), it could be due
directly entrusted with the carrier (ship) by shippers or shippers who are recognized
(new regulation from 1991). In that case, shippers or shippers who are entrusted to

the direct cost to the carriers and only deals with the port about loading and
unloading sites, payment of related expenses..
- The loading and unloading of cargo within the port due to port implementation. In
case owners wish to take the means to unloading must agree with the port and pay
the fees and expenses related to the port.
- When receiving the goods entrusted to exporting ships, port of loading by the right
method of delivery by that method.
- Port is not responsible for the goods when the goods were out of warehouses and
ports.
- When receiving goods at the port, the shippers or consignees must present the
valid documents identifying the right to receive goods and to receive a continuum in
a certain time goods voucher. For example, the original bills of lading, letter of
recommendation by the agency ....
- The delivery may be performed by shippers (directly) or ports (follow trustees)

International law:


The UN Convention on Contracts for the International Sale of Goods (CISG, the
Vienna Convention in 1980) is a treaty that provides for a sale of goods law
internationally agreed. As of August 2010, it was ratified by 77 countries accounting
for a significant proportion of world trade, making it become one of the
international law the most successful uniform. Benin is the most recent state
ratifying convention. CISG allows exporters to avoid the problem of choosing law,
CISG provide "acceptable content rules which the contracting parties, courts and
arbitrators may be based on".
CISG was developed by the United Nations Commission on International Trade
Law (UNCITRAL), and was signed in 1980. CISG sometimes known as the Vienna
Convention (but not to be confused with the Other agreements were signed in
Vienna). It operates as a multilateral treaty on January 1, 1988, after being ratified
by 11 countries. CISG has been regarded as a success for UNCITRAL, because ever
since the convention was adopted by the country in many different geographical
areas, each stage of economic development and all legal systems law, social and
economic big ". The country has ratified the CISG is mentioned in the treaty as"
The Contracting States ". Unless excluded by the terms of a contract expressed, the
CISG is considered to be incorporated into (and replace) any domestic law does not
apply if a transaction concerning goods between parties from different Contracting
States. Among the conventions of uniform law, CISG has been described as having
"the biggest influence on the legislation on cross-border trade in the world".
CISG has been described as a great legislative achievements, and "international
document the most successful so far," the law of international sale of goods unified,
partly because of the flexibility Its operation allows countries signing the optional

exception for a certain number of terms. This flexibility is helped to persuade
countries with different legal traditions register a different uniform regulations.
Some countries have signed the CISG has declared and dedicated some provisions
covered by this Convention, although the vast majority - 55 of the 76 countries
present signed - has opted Convention without any specific terms yet.
Another international regulation is Incoterm 2010 standard interpretation of trade
term in International Chamber of Commerce. This basis defines the right, risk and
obligation clearly between consignee and consigner in international trade.
6. Related documents in freight forwarding services for import and export

cargoes
Freight forwarding services by sea requires a lot of vouchers. The classified
documents have important implications in the management and use documents. For
simplicity and ease of navigation, we can be divided into two categories:
-

Export voucher:

When exporting goods by sea, forwarder is entrusted by the consignor for care
about their cargo from customs clearance until cargo are loaded onto the ships. The
documents used in this process are as follows:


Customs documents:

a. Customs declaration
Customs declaration is a document that are declared by shippers or carrier to

produce to the customs authorities before the goods or vehicles export or import
through the national territory.
International practices and Vietnamese law stipulates the customs declaration is
mandatory for export or import vehicles through the national gate. All violations as
undeclared or dishonest declared will be handled under existing laws.
b. Foreign trade contracts
The foreign trade contract is an agreement between the involved parties that
headquartered are in different countries, according to which the exporter is obliged
to transfer to importer a certain property called cargo. Importer are obliged to
received goods and pay for the purchase.
c. Certificate of business registration and certificate of businesses registration code
Previously businesses Import Export must submit import-export business license
(type 7 digits) that provided by the Ministry of Trade. Now all businesses meet
certain conditions (legal, capital ....) that have direct export rights.
d. Cargo list

Cargo list is the detailed documentation of goods in shipments. It creates favorable
conditions for the inspection of goods. Also it has additional effects for the invoice
when the shipment includes many kinds of different name and the different levels.


Vouchers for ports and ships


Being entrusted by the shippers. forwarder contact to ports and ships to track
handling goods processes. The documents used in this phase include::
- Ship’s stowage plan
a. Instruction queue:
This is indicative of the shipper for shipping companies and port authorities,
companies handling, provide full details about the goods to be delivered to port for
loading on ships and the necessary instructions,
b. Mate's receipts
Mate's receipts is a document provided by mate in charge of the shipper issued to
the shipper or ship owners confirm you have received the goods. The receipts mate
is an acknowledgment that the goods have been loaded onto ships, were handled
appropriately and carefully. Therefore during transport people receiving state if the
packaging is not sure, then take notes on receipts mate.
c. Bill of Lading
Bill of lading is a transportation document seaborne goods by the carrier or their
agents for the consignor after the goods are loaded onto ships or after receipt of
goods for loading.
Bill of lading is an very important, fundamental transport document about the
operations of the consignor to the carrier, the consignor to the consignee. It acts as a
proof of commodity exchanges, a evidence of the contract of carriage
d. Cargo manifest
This is a enumerated goods document that loaded on ships for transport to different
ports that established by the agent at the loading port of lading
Manifests must be prepared day after shipment, also can set up while preparing to
sign a bill of lading, nonetheless must be completed and signed prior to the
procedures for the ship to leave port.
The manifests provided statistics on exports and imports and is the basis for the
transport company (ship) used for comparison at unloading

Docksheet is a tallying sheet at piers on which records the number of delivery of
goods has been forwarding at the berths

tally sheet is a sheet of goods have been loaded on the ship by the tallymen
responsible notes
the jobs of tally in ships, depending on the regulations of each port has a number of
other documents such as scorecards quantity, daily reports ....
Tally sheet is an original documents on the quantity of goods loaded onto the ships.
Therefore copy of tallying votes must be given to mate in charge of goods to a store,
it was necessary to appeal the loss of the goods later.
f. Chart queue
This is the arrangement drawing line position on the ship. It can use different color
marker for each row different ports for easy monitoring and inspection at the port of
discharge ebb.
Upon receipt of the registered freight sent by shippers, the staff captain moderation

Import vouchers:

a. Certificate of origin

Certificate of origin is a vouchers that note about production place, established and
signed by exporter. confirmed by competent persons at exporting country.
This document necessary for the customs authorities according to the policy of the
State to apply the preferential treatment when taxable. It is also necessary to
monitor the implementation of the quota regime. At the same time certain extent, it
speaks of quality goods because local characteristics and production conditions that
affect the quality of goods.
b. Commercial invoice
After delivery export cargo, the exporter must prepare a commercial invoice. It is
the request of the seller requires the buyer to pay the amount they have been
recorded on the invoice.
c Packing list
The packing list is the inventory for all the goods contained in a shipment. The
packing list is used to describe how to package goods such as parcels are divided
into many packages, the type of packaging used, the weight of packaging,
packaging size, the signs may on packing ... packing list is placed in the packaging
so that shoppers can easily find, also when in a bag attached to the outside
packaging..
d. Certificate of quantity/weight

This is a deed which established by exporters, importers grant to determine the
weight of the goods delivered

However, to ensure neutrality in the delivery, the importer may ask the export
certificate number / weight set by a third party, such as inspection company,
Customs or producer.
e. Insurance vouchers
Forwarder at the request of the exporter can buy insurance for the goods. Insurance
documents are the documents issued by the insurance agency for export and import
unit for certifying the insured goods and proof of insurance contract. Insurance
vouchers is often used as an insurance policy or Certificate of Insurance
7. FCL and LCL

FCL: FCL is the abbreviation of the phrase "Full Container Load" is used in the
shipping industry internationally for export and import goods for sea transport.
This term is often used to describe an international maritime service designed for
ocean freight of the goods that an exporter, importer has exclusive use of a transport
container Dedicated marine loading (typically a 20ft container or 40ft). Container
freight by sea usually are loaded and sealed at the base and then transported by a
combination of sea, rail and / or road to last place.
LCL: In the field of freight forwarding goods LCL abbreviation of the phrase: Less
than Container Load. This phrase describes how the transport of goods when the
goods are not enough to packing in an entire row of containers, so that it should
melding with some batches of the other shippers.
Meanwhile, the company will combine retail shipments (LCL shipments), sort,
classify and starred in the container, then arrange transportation from the port to the
destination port. The combination packaging together so-called consolidation, or
consolidation..
8. Freight forwarding general process

Export process:
Absolving: Enterprise must be licensed for export in competent authorities, ask
once for multiple occurrences.

Package:
* With FCL cargo:
- Shippers or shippers who are entrusted fill in the booking notes and gave
representatives of shipping firms to get up with the list of exporting (cargo list)

- After registering the booking notes, the company will issue orders and bring empty
containers to shippers borrow
- Shippers take empty containers for packing.
* If sending LCL (LCL):
- Shippers sent booking note to shipping lines or agent of the shipping line,
providing them with the necessary information about export goods. After booking
