We do not agree with the delay reason.

We already sent photo about packing style in oct 20
But you don’t have any comment about packing style and even when your
company pick-up cargos, there is no reply about packing style. And this happen
after cargos arrived your warehouse, not when you pick-up from our vendor. So we
think, this damaged packing cause from abc company when you was not carefully
in loading and unloading process.

Until now, suddenly you inform delay, we totally disapprove this situation. Each
day we delay shipment, we have to pay penalty fee to our customers and our
reputation is affected badly, so that fee, can you cover for us?
This way we feel very irresponsible and unprofessional.

Good morning.


As I sent email to 0000000 on Saturday 1:35AM, soon after I received the message
from our office in Germany;

1) If you want us to do packing at Hamburg, the packer needs at least 4 working
days and its cost is about EUR1850.
Since the cut off of the current vessel schedule is 11 April, there is no way but to
postpone the vessel schedule until the next week (ETD 22-April/ETA 26-May)

2) If you want to catch the current vessel schedule (ETA 19-May), we may
negotiate with carrier to accept the shipment as current packing.
However 000000 told me the goods is easy to be broken, and because it is mostly
without packing, the carrier and HHE need to add an exemption] clause on BL as
below:

“the packaging is not transport related. according to chapter 11 / paragraph c of the
carriers b/l terms and conditions, the carrier will not assume any liability for
damages incurred due to insufficient packaging between the time of reception of
the cargo at hamburgcfs until delivery to the consignee.”

3) If you want it ship by air, it needs to be transferred to Dusseldorf.
Because the shipment is over-sized (exceed 300cm length, and over 150cm height)
no flight ex. Hamburg cannot board it.
It must be a freighter fleet.
In Dusseldorf, we have our own office (Hamburg is only CFS of Co-Loader. Not
our facility), so our staff can check the cargo and arrange packing in our facility.


The packing fee is lower than in Hamburg (we estimate it EUR1200)
It will take about one week from Hamburg to Dusseldorf, then finish packing.
The transit time from Dusseldorf to SGN is about 3-5days normally.

Our Germany office will open from 8AM local time(therefore 3PM in thai lan).
Please let us have your instruction, and I will give them to start arrangement
immediately.

Well noted your instruction to ship it by air.
However, I’m afraid, we cannot bear the additional freight cost and packing fees.

For this shipment Customs Clearance was done by shipper and we received the
cargo being bonded.
Therefore it was already under Custom’s Control when we receive it.
That means, it is your shipper’s responsibility to do proper packing before customs
entry, because it is basically not allowed to change the packing after customs
clearance.

For this shipment, we need to arrange amendment of customs declaration if you
need packing arrangement.

I understand you sent a picture of one of the goods.
However we do not have knowledge about your products, though we have skills
about transportation.


When shipper or consignee would explain the detail about their products as what
their products like, how sensitive it is and how it shall be protected, we could
advise a proper packing way.
But it is impossible for us to give you an proper advice with only one picture. Even
our Germany office asked it to shipper they only told “they don’t know”.
For such matter, shipper and consignee need to discuss directly in advance, then
instruction or consultation shall be given to forwarder.

I acknowledge our Germany office reported such irregular information to shipper
only, but they should have inform to thai lan side at the same time.
However I have to say that we did not receive enough instruction and information
in advance, and it was not possible to avoid any trouble in advance.
To support our important customer, of course we will arrange the air shipment at
best price without our profit, and also will negotiate with all service providers, but
cannot bear all of it.

Please kindly accept additional cost, or please discuss with your supplier how to
share the cost.
Then we will arrange the shipment as your instruction, and will issue billing as
your instruction.

I understand your point, but your Germany pick up cargos directly and already see
cargos packing situation, why they don't inform immediately but waiting until 1
days before ETD to inform unproper packing situation?
If they inform earlier, we can have solution and no delay happen.


Please note it is impossible to judge it at pick up site, because the pick up is done
by driver.
Driver’s responsibility is to check whether there is visible damage outside, and to
move the cargo from pick up location to delivery location safely.
The tally and judgment whether to accept it into their container is done by coloader (carrier) at their CFS.
Even in thai lan or in Japan, truck driver has no right to decide whether
airline/vessel company will accept the cargo or not.
It is always checked and decided at terminal by airline/vessel company’s staff.

The shipment arrived in CFS on 4th April in Germany, and at that time carrier
refused to accept it.
There is no way but to postpone the schedule one week.
Our Germany office received the picture of the cargo on 5th from CFS, it was the
first time we saw the whole pieces.
Our Germany office requested shipper to give us instruction, but they didn’t reply
to us on that day, and when we called him,
he told he received any instruction from destination and it is none of his business.
HHE/VN received the information on 6th. Because of the time difference with
Europe, it was the fast available timing.

Please understand the main root of this problem is coming from insufficient
packing.
If the packing was proper, we could arrange the original vessel.

If we had informed it needed packing, we could quote the cost and time needed,
then could arrange proper packing and pick up date.
The delay of report is the secondary.


And such report shall be done by shipper to you at the same time, because they are
your counterparty and business partner, right?

As requested by Mr…our office in Germany is arranging to switch the shipment
via air.
The shipment will be transferred from Hamburg to Dusseldorf within this week.
After that, it will be checked and re-packed, then to be exported to EU.

Please kindly be advised that I visited shipper's factory last week, and we found the
machine is very old and with machine plate.

As the machine long to 6.5 meter and factory asked us we need move out by our
arrangement. The cost will be paid by consignee.



I'm push move out & packing company offer relative charge to us and will offer
the quotation to you.

Here we attached photo for your reference.

Basically except machine, also have around coil (10 unit).

Our plan is main machine put on pallet, other steel coil put on pallet for 10 Pallet.

Control Box will be vacuuming wooden case packing for your reference.

When I checked the machine in factory, the factory owner informed they only
provide the warehouse space for Mr. B seems they are good friend for many years.

The factory produce same products with Mr. B company and I think they can do
this job, only the problem is if they have time and charges?

Could you give us in detail about stamping procedure for your machine. What kind
of stamp? Do you have a sample?. After you give us full information we will check

with ABC side.

For cleaning machine we will ask abcd for this issue, however please ask you
seller directly for more easy.

This is a 2 nd machine shipment so import procedure is very complicated so If
your manager have any urgent inquiry please contact direct to ddd manager as

cargo is comparatively big and heavy.
Additionally this cargo is in TNN

This shipment is under CIF term. So firstly we confirm with Mr. k.
